Do renters have to let home owners in home to show if home is on the market?

July 2nd, 2010 | by admin |

I am renter and going on vacation and home is currently on the market and the home owner/property manager says I have to let them have access to home while I’m on vacation to show home. Aren’t I protected by tenants rights? Can I require that I have to be here when they come in?

You are protected by landlord tenant laws, but you’ve neglected to tell us what state you are in, so I can’t tell you what your rights are.

In most states, a renter is REQUIRED by law to allow the landlord or his agent access to the house to show it for a purpose of selling it. The amount of notice that the landlord is required to give you varies GREATLY by state. And in most states, leaving a message on your machine or sending you an e-mail does count as notice, regardless of if you received the message. http://www.nolo.com/legal-encyclopedia/chart-29033.html

I think you CAN require that you be there when they come in. You’re going to need to talk to a tenant’s rights advocate or attorney in your area. Many cities have a tenant board or something like that. It seems fair to not have something running around your home when you’re away.

I think they can, as long as they already notified you.

Just put away anything that someone might be able to grab and put in their pocket.

They have every right to show the property upon reasonable notice. While you are on vacation no notice is required. While you can be present at showings you can’t require that you be present. Showings won’t be scheduled around your schedule.

In most states the landlord is only required to post a notice that he/she intends to enter the property. Your permission or attendance is NOT required. The landlord has the right to show his property even when your on vacation.
