if someone accuses you of stealing personal property an the police get involved can they get a search warrant?
February 17th, 2010 | by admin |I mean all they have is the person accusing us of stealing it because we were there when it "disappeared" but they don’t have any real proof saying that we stole it. Neither of us have it but having the police come search or homes seems dis-respectful.
It will take a lot more than that for the police to try to get or even to get a search warrent.

You don’t give enough details.
If it was a pack of gum, the police aren’t going to get involved.
If it was a $1,000,000 diamond ring, expect a visit from the cops.

All the need is a signed warrant and probable cause for the search and that a judge to sign it, might seem disrespectful but the evidence speaks for itself.

Respecting you isn’t the issue. It is respecting your rights (4th amendment). Probable Cause is all that is required to get a search warrant. Not reasonable doubt.

If the police can show cause for a search warrant, they can. They will question you and anyone else accused first.

The Police may try to search your home but unless they have a warrant you have the right to say no. The most important thing to remember is do not under any circumstances let a police officer into your home without a warrant

I dont think you would find it "dis-respectful" if you were the one missing something.
Secondly, the police have to be issued a search warrant from the court, meaning the police have to have reasonable belief you may have what is missing.
If you dont have anything to hide you shouldnt be worried, but I have a feeling you do.

Call the police and ask them. Of course you wouldn’t give them your name or where you live. just tell them you have an acquaintance who is causing you a problem. But don’t call 911 they don’t have time for that.

It takes a Judge to get a search warrant. The police must have good evidence to take to the judge to get one.

Police usually get a search warrant issued to them when they have probable cause to search for something. It might depend on the attorney or a court decision. If they do get a search warrant on you though, the best thing to do is just let them search.

"because we were there when it "disappeared"" does not meet the definition of probable cause which is required for a search warrant in my mind, especially since the person really doesn’t know when it disappeared! If anyone is stupid enough to issue one, they can’t give carte blanche searches under the constitution for a witch hunt!

yes they can get a search warrant,,but in IL what sucks if you get enough people to say you did it, you can go to jail..
this happened to my brother and since all four of them couldn’t get there story straight the dropped the charges.
they accused him of stealing stuff too, and even had private det following him.
and what they accused him of didn’t come out to a total of a hundred grand like that one person said..
if it is something minor they wont bother but something over 500.00 or more they will investage

They cant search your house without a warrent. Although it may look suspecting if you dont allow them to.
