Can the police issue a search warrant for my home? or search it again?

November 28th, 2009 | by admin |

My boyfriend has a warrant out for his arrest the police kicked in his moms door but couldn’t find him she or someone else told them he was at my home. So they came to my house with the property manager claiming he and the police can search my house because he is property manager. Can the police issue a warrant for him here even though hes not on my lease or can they search my house again ???? Please Help ASAP

Let me guess, you need help ASAP because he’s getting tired of hiding under the bed, right? Of course the police can search your place if they reasonably suspect that you are hiding him.

Oh, and if you are hiding him, I’d turn him in unless you want to get slammed with a obstruction of justice and an aiding and abetting charge.

Yes, if they have reason to believe he’s in your house they can search it.

If you hide him expect to join him in jail when they do enter.

If they have reason to suspect he’s there, they can get a warrant in 5-10 minutes, and be there soon after. Your best bet is to be as cooperative as possible, and not doing anything dumb (like having pot out on the table- not saying you would, just an example =) )

Of course they can and they probably will. You could also get in trouble for hiding him.

Police do not issue warrants. They submit an Affidavit of Probable Cause to a judge who then may issue the warrant. The the police then serve the warrant. The property manager may not search your home absent an emergency or as described in your rental agreement or lease. If your address is the same as your boyfriends address of record some states allow warrant-less entry to search for a subject who has a valid arrest warrant if the police have probable cause to believe the subject with the arrest warrant is inside.

If the property manager lets them in then they do not need a warrant to search your house. The property manager acts as the owner and he is allowing them into the his home. A warrant only lets them search a house when they do not have permission. It is a piece of legal paper stating a judge allows them to enter the home and no permission is needed to enter.
