Does Sec 8 Landlord have access to rental property to fix window when tenant isn’t home?
January 27th, 2010 | by admin |I have called tenant 2 times and left messge that i was coming to fix broken window in attic that they reported to me. I mailed a letter 3 days in advance (reg mail- not certified) giving them the day and time i was coming with window repairman. Since i did not send letter certified do i have rights to enter property and fix window if tenant doesnt answer door or are not home? Tenant has not returned my call.
Yes, of course, use your key. Knock LOUDLY first though, especially if your tenant is a drug addict.
They do not have to confirm notice, you are only required to give it.

You have notified the tenant of the appointment with the repair person. As long as you gave 24 hours notice, go in there with the repairman. The tenant was notified and it is the tenant’s choice to be home while the repairman is there or not.

What was on the lease agreement with this individual. If you put on there that you have a right to inspect, or a right to be in there on your agreement and they have signed it then yes you do have that right. My suggestion is that if you’re not able to get a hold of the individual, I would have the police accompany you into the premise. Explain the situation to them, and they will be willing to do this, and then it is legal, and if there are any problems, then at least they would have that premise.

Yes! A section 8 tenant is the same as everyone else. If something needs to be fixed you give them 24 hrs notice and go do it. They do NOT have to agree to it or be home. A phone message the day before is legal in most states.
You have the right to protect your property by doing needed repairs.
